Overview
Congratulations on your engagement!
If you’re visiting this page, it probably means that either you or your partner isn’t a U.S. citizen, but you are planning on building your life as a married couple in the United States.
What is a K1 visa?
A fiancé Visa allows a U.S. citizen to sponsor a loved one from a foreign country to enter the United States for the purpose of getting married. It is the most commonly used method by international couples to meet and marry within the United States.
This visa allows a foreign fiancé to enter the U.S. and marry the U.S. citizen sponsor within 90 days after entry into the United States.
Should the couple have a change of heart and decide to not get married at that point, the foreign national must then leave the country within this time period or be faced with a removal hearing.
K1 visa processing time
It usually takes at least five to seven months to get a fiancé Visa from the initial application to the time the visa is granted. It is important to mention that the processing time varies depending on certain factors like:
- The country the alien belongs to.
- The current workload of the USCIS and the NVC.
- Unforeseen events like natural disasters.
- The accuracy and completeness of the petition that you have submitted.
After our FREE Initial Consultation I will be able to give you a proper clear idea on how long should this Visa process be for your specific case, based on your particular circumstances.
Requirements
Legal requirements
For this particular visa, there are strict legal requirements in place, and a broad variety of documents that must be rendered. The manner and promptness in which these documents are provided to the Immigration Authorities marks the difference between a successful application and an unsuccessful one. This is why it is so important that you count with the correct legal representation and guidance. To provide you with initial guidance, these are ALL the legal requirements you must meet to be eligible for this Visa:
- The Petitioner partner must be a U.S. citizen.
- The U.S. citizen and foreign fiancé must be FREE to marry (i.e. all previous marriages must have been terminated by divorce, annulment, or death of the former spouse).
- The U.S. citizen and foreign fiancé must have met in person at least once in the previous 2 years- Unless an exception applies, which I can carefully discuss with you during our Legal Consultation).
- The U.S. citizen and foreign fiancé must have a present intent to marry after the fiancé visa is issued and must be willing to marry within 90 days of entry into the U.S. by the foreign fiancé.
- The foreign fiancé has not been convicted of a crime, has never entered the U.S. illegally or overstayed for 6 months or longer, and does not have a history of detentions/removal/deportations by the Department of Homeland Security- Waivers may be available for such conduct, but they require me to carefully discuss them with you during our Legal Consultation.
- The U.S. citizen fiancé must have filed taxes with the IRS during the previous three years, is currently employed or self-employed, and is earning at least the minimum income level set forth by the U.S. Poverty Guidelines- I can discuss this term with you during our Legal Consultation.
- The U.S. citizen fiancé has NOT filed two or more K-1 fiancé visa petitions at any time in the past and has NOT had a K-1 visa petition approved within two years prior to the filing of the current petition- Waiver may be available for this requirement but they require me to carefully discuss them with you during our Legal Consultation.
- If the U.S. citizen fiancé has been convicted of any of certain legal offenses, which I can carefully discuss with you during our Legal Consultation, then certified copies of all police and court records showing the charges and final disposition for every conviction must be submitted with your K-1 fiancé Visa petition.
